Welcome to Poka Luxe (“we,” “our,” or “us”). These Terms and Conditions govern your use of our website https://pokaluxe.com and any purchases made through it.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, you must not use our website.

2. Eligibility

You must be at least 18 years old to use this Service or make purchases.

3. Products and Services

Poka Luxe offers:

  • Ready-to-buy items (in stock)
  • Pre-order items
  • “Source For Me” services, where we source items on your behalf

All product descriptions, images, and prices are subject to change at any time without notice.

4. Orders and Acceptance

  • All orders are subject to confirmation and availability
  • We reserve the right to refuse or cancel any order at our discretion
  • Once an order is confirmed and processing begins, it cannot be freely canceled (see Refund Policy)

5. Pricing and Currency

  • All prices are listed in Ghana Cedis (GHS)
  • Prices may change without prior notice
  • Additional costs such as shipping, duties, or taxes (for international orders) may apply and are the responsibility of the customer

6. Payment Terms

6.1 In-Stock Items

Full payment is required before order processing and delivery.

6.2 Pre-Order & “Source For Me” Items

  • 70% deposit is required to confirm the order
  • The remaining 30% balance must be paid within 7 days after the item arrives and you are notified

7. Default and Non-Payment

If the remaining balance is not paid within 7 days:

  • The order will be considered defaulted
  • The item may be released for sale to other customers
  • Your deposit is not forfeited, but it will only be refunded after the item is successfully resold
  • Refund timing is not immediate and depends on how quickly the item is resold

8. Shipping and Delivery

  • We deliver within Ghana and internationally
  • Delivery timelines vary depending on product type (in-stock vs sourced), location, and external logistics factors

Important:

  • We are not responsible for delays caused by couriers, customs, or unforeseen circumstances
  • Risk transfers to the customer once the item is handed over to the shipping provider

9. Refund and Return Policy

9.1 Eligibility for Refunds

Refunds are only granted under the following conditions:

  • The item has not yet been ordered or processed
  • The wrong item was delivered
  • The item arrives damaged or defective

9.2 Non-Refundable Situations

Refunds will not be granted for:

  • Change of mind after order confirmation
  • Delays outside our control
  • Minor variations (e.g., color tone, packaging differences)

9.3 Damaged or Incorrect Items

  • You must notify us within 48 hours of delivery
  • Provide clear evidence (photos/videos)
  • We will assess and either replace the item or issue a refund where applicable

9.4 Pre-Order / Sourced Items

Deposits are non-refundable once sourcing or ordering has begun, except when the wrong item was delivered or the item is defective.

10. Intellectual Property

All content on this website (images, branding, text, design) is the property of Poka Luxe and may not be copied, reproduced, or used without permission.

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid for the product
  • We do not guarantee uninterrupted or error-free website operation

12. User Responsibilities

You agree:

  • To provide accurate and complete information
  • Not to misuse the website
  • Not to engage in fraudulent or illegal activity

13. Third-Party Services

We use third-party providers including payment processors, shipping companies, and marketing and analytics tools. We are not responsible for their actions, policies, or service failures.

14. Termination

We reserve the right to suspend or terminate access to our Service at any time without prior notice if you violate these Terms.

15. Governing Law

These Terms shall be governed and interpreted in accordance with the laws of Ghana.
